REGULAR COUNCIL MEETING
APRIL 27, 2023

A regular meeting of the City Council of Vinton, Iowa was held on the 27th day of April, 2023 at 7:00pm in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and the roll being called the following members were present: Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark.

Motion by Gates, seconded by Parmater to approve the agenda with the following change to old business 8e – “approve referring petition for rezoning to Planning & Zoning”. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Stark, seconded by Pflughaupt to approve the consent agenda. Question: Ayes – all. The Mayor declared the motion carried. Items on the consent agenda include receive & file Council work session and meeting minutes of April 13, 2023, receive & file Library board meeting minutes of March 8, 2023, receive & file Parks & Recreation board meeting minutes of March 9, 2023, approval of Class E retail alcohol license for Fareway Stores, Inc and approval of City invoices.

City Council received an invitation to visit the airport from the Airport Commission and a resignation letter from Craig Merchant from the VMEU/VMCU board effectively immediately.

Committee Reports
A 2nd meeting was held with the department heads to discuss requested changes to the employee handbook. A council work session is requested for May 11, 2023 to present the requests to the full council for future consideration.

Citizens Input
Nate Edwards, 704 W 17th Street, requested increased public access to the brush and compost yard.

Mike Dominic, 1102 3rd Avenue, spoke against approval of the special events application that is later on the agenda for consideration or at a minimum, requested clarification of the event.

Sam Thompson, 1013 7th Avenue, spoke in support of the special events application request on the agenda.

Old Business
Mayor Maynard opened the public hearing on proposed ordinance to amend the zoning district map (Berry). After no comments, Maynard closed the hearing.

Motion by Stark, seconded by Pflughaupt to third consideration of Ordinance 1081 – an ordinance amending the official zoning district map of the City (Berry). Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Elwick, seconded by Gates to adopt the above stated ordinance. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Hessenius, seconded by Parmater to approve the third consideration of Ordinance 1082 – an ordinance adding provisions pertaining to the installation of expansion tanks and combination temperature and pressure relief valves. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Elwick, seconded by Gates to adopt the above stated ordinance. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Gates, seconded by Hessenius to accept the withdrawal of petition for rezoning at 903 B Avenue. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried. This request was for rezoning from R1 to R3.

Motion by Gates, seconded by Pflughaupt to forward the petition for rezoning for 903 B Avenue to the Planning & Zoning Commission. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried. The request is for rezoning from R1 to B1.

Mayor Maynard opened the public hearing to approve the FY24 budget. There is a 8.7% decrease in the property tax rate for the upcoming year. Maynard closed the hearing.

New Business
Mayor Maynard opened the public hearing on the proposed contract documents and estimated cost for the B Avenue Sanitary Sewer extension project. After no comments, Maynard closed the hearing.

Motion by Stark, seconded by Parmater to approve a resolution adopting plans, specifications, estimate of cost and form of contract for the B Avenue Sanitary Sewer extension project. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Pflughaupt, seconded by Gates to accept the bids and awarding of contract for B Avenue Sanitary Sewer extension project to Arends Excavating at a cost of $70,240.04. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Mayor Maynard opened the public hearing on proposed contract documents and estimated costs for improvement of the East Water Tower Painting Project. The project will be a re-coat of the inside and outside of the tower. The paint scheme will be the same as the West Tower. Maynard closed the hearing.

Motion by Parmater, seconded by Elwick to approve a resolution adopting plans, specifications, estimate of cost, and form on contract for the East Water Tower Paint project. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Gates, seconded by Pflughaupt to accept the bids and awarding of contract for East Water Tower Painting Project to JR Stelzer Co. at a cost of $349,075.00. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Stark, seconded by Parmater to approve a resolution adopting the annual budget for the fiscal year ending June 30, 2024. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Pflughaupt, seconded by Hessenius to approve a resolution to approve the improvements required of certain real property (512 W 6th Street). Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Gates, seconded by Elwick to approve a resolution proposing disposal of an interest in real property by sale and notice of public hearing (512 W 6th Street). Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried. The public hearing is set for May 25, 2023.

Motion by Gates, seconded by Hessenius to approve a resolution to approve the improvements required of certain real property (305 E 5th Street). Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Gates, seconded by Elwick to approve a resolution proposing disposal of an interest in real property by sale and notice of public hearing (305 E 5th Street). Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried. The public hearing is set for May 25, 2023.

Motion by Gates, seconded by Parmater to approve a resolution to authorize the creation of an ad hoc rental code advisory committee. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Mayor Maynard made the appointment of John Watson, Gary McKenna, Chad Christoph, Matt Johnson, Alan Michael, Andrew Hilton, Cody Bergmeier, Ron Hessenius and Bethany Gates to the Rental Code Advisory Committee.

Motion by Pflughaupt, seconded by Gates to approve the insurance renewal with PDCM Insurance for the upcoming year. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Parmater, seconded by Gates to approve the quote from Stanley Roofing for roof edge sealing project at the Vinton Veterans Airport. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Stark, seconded by Pflughaupt to approve the bid from Koops Sales and Service for mower purchase & trade. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried. The purchase is already included in the VPRD budget.

Motion by Pflughaupt, seconded by Parmater to approve the business improvement grant for North Benton Ambulance. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Elwick, seconded by Hessenius to approve the special events application for Benton County Pride on July 1, 2023. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Stark; Abstain – Pflughaupt. The Mayor declared the motion carried.

A public hearing has been set for May 25, 2023 at 7:00pm in City Hall for the fiscal year 2023 budget amendment.

Reports
City Administrator Ward reported a member of the Corbett Family stopped by City Hall and shared the family is pleased with the wetland project on their old property.

City Clerk Schwan reported she received notification she has been awarded a scholarship for the summer Clerk classes.

Parks & Recreation Director Boggess reported installation for the new playground at Riverside will begin next week. The pool has been washed in preparation of the season.

Mayor Maynard requested citizens come to speak to City staff before filing complaints with State agencies to see if remedies can be reached first.

Good & Welfare
VPRD’s Bike Safety rodeo is next week, May 2nd at 5pm in the Rec Center parking lot.

With no other business before the Council, motion by Hessenius, second by Gates to adjourn. Approved
