REGULAR COUNCIL MEETING
JULY 26, 2018
A regular meeting of the City Council of Vinton, Iowa, was held on the 26th day of July, 2018, at 7:00 p.m., in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and the roll being called the following Council Members were present and absent: Present: Elwick, Hessenius, Hesson, Parr. Absent: Edwards, Stark.
The Pledge of Allegiance was recited.
Motion by Elwick, second by Hesson to approve the agenda. Question: Ayes – All. The Mayor declared the motion carried.
Motion by Hessenius, second by Parr to approve the consent agenda. Question: Ayes – All. The Mayor declared the motion carried. Items on the consent agenda are to receive and file the Council meeting minutes of July 12, 2018, the Parks and Recreation Board meeting minutes of May 10, 2018, the Airport Commission meeting minutes of June 21, 2018, to receive and file the building inspector report for June 2018, to approve the renewal of a class c liquor license with Sunday sales for Berry’s Lanes and to approve the renewal of a class b liquor license with Sunday sales for Cobblestone Inn.
The Mayor announced that now was the time and place set to hold a public hearing on a proposal to vacate E 14th Street in the Eastview Estates Third Addition. The Planning and Zoning Commission met on July 9th and recommend the vacation of said street. Tracy Davis is interested in purchasing lots from Todd Gloede in this addition. A private driveway will be made. The Mayor closed the hearing.
Motion by Elwick, second by Hesson to adopt an ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A STREET IN VINTON, IOWA. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and that said ordinance had been given its initial passage.
Motion by Hessenius, second by Parr to adopt an ORDINANCE ADOPTING AND AMENDING PROVISIONS REGULATING THE OPERATION OF UTILITY VEHICLES TO THE MUNICIPAL CODE OF VINTON, IOWA. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and that said ordinance had been given its second consideration.
Motion by Hesson, second by Parr to adopt an ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF VINTON, IOWA, BY AMENDING PROVISIONS PERTAINING TO SOLID WASTE COLLECTION AND RATES THEREOF. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and that said ordinance had been given its second consideration.
Council reviewed a management plan from J & R Sanitation, LLC regarding collection of residential waste. This was required per the RFP for the contract for garbage and recycling collection. The approval of the management plan will be on the next council agenda.
Motion by Parr, second by Hessenius to set public hearings on the voluntary annexation of land owned by St. Mary Catholic Church and the voluntary annexation of land owned by the Vinton-Shellsburg Community School District for August 23rd at 7:00 pm. Question: Ayes – All. The Mayor declared the motion carried.
Motion by Hesson, second by Elwick to pass a RESOLUTION SETTING DATE FOR PUBLIC HEARING ON 2018 AMENDMENT TO URBAN RENEWAL PLANS FOR VINTON URBAN RENEWAL AREAS. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and declared RESOLUTION 07-18-02 passed and approved. The public hearing is set for August 23rd at 7:00 pm. The proposed amendment will consolidate TIF areas and include the IBSSS campus, Kiwanis Park, E 3rd Street and the new annexations. The areas are contiguous.
Motion by Elwick, second by Parr to approve participating in the Community Catalyst Building Remediation Program Grant and to authorize the Mayor and City Administrator to sign the letter of intent. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried   The Mayor declared the motion carried. This program will assist the four businesses that were destroyed by fire back in February.
Council discussed the use of ATVs in town. The State regulates ATVs like snowmobiles. The City’s current ordinance for snowmobiles applies to ATVs. Engineer Nate Kass will discuss street projects with Superintendent Erickson on Friday.  Building Inspector Michael has been working to contact the owners of the old braille school power plant to have them fence of the building. Administrator Ward stated there has been a recent change in state law regarding nuisance properties to now include non-residential properties. A resolution to hire outside legal counsel for this subject will be on the next council agenda. The watershed management study is done. They are now asking for a FEMA report. Administrator Ward has done department head reviews. He will provide council a review form for the clerk. Attorney Fischer is getting close to hiring a contractor for his new building. Council asked Administrator Ward if the Vinton Park Apartments could be considered a business and not as residential in regards to garbage and recycling. The ordinance regarding the garbage and recycling collection may have to be amended.

Motion by Hessenius, second by Hesson to adopt an ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF VINTON, IOWA, BY AMENDING PROVISIONS PERTAINING TO ALCOHOLIC BEVERAGE CONTROL. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and that said ordinance had been given its initial passage.
Motion by Elwick, second by Hessenius to adopt an ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF VINTON, IOWA, BY AMENDING PROVISIONS PERTAINING TO CIGARETTE AND TOBACCO PERMITS. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried and that said ordinance had been given its initial passage.
Motion by Hesson, second by Elwick to approve street closures for BoomTown and BoomFest events on August 25th and street closures for the Library’s Craft Beer Tasting Festival on August 11th. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried
Motion by Hesson, second by Hessenius to approve the disbursement of $23,000 from the General Fund to Vinton Unlimited. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried.
Motion by Elwick, second by Hessenius to approve a sidewalk reimbursement to Craig Roster, 602 E 3rd Street, in the amount of $480. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried.
Motion by Hessenius, second by Elwick to approve a sidewalk reimbursement to Carl Summers, 1109 W 3rd Street, in the amount of $500. Question: Ayes – Elwick, Hessenius, Hesson, Parr. Nays – None. The Mayor declared the motion carried.
Motion by Hesson, second by Hessenius to hold a special council meeting on August 2nd at 7:00 pm to receive an IBSSS Committee report. Question: Ayes – All. The Mayor declared the motion carried.
The new logo on the water tower should be completed by the end of next week.
Administrator Ward said the summer conference he attended was good. VMEU is planning a special meeting on August 16th.
The hotel/motel tax is to start January 1st. Clerk and Administrator will discuss tasks the day after a council meeting. A lien for veterinary expense for the Galkowski case is not necessary because there is already a court judgement. Allan Merchant is planning to move the old park house on August 3rd. Some residents have requested the smaller garbage cans, but J & R Sanitation does not currently have them available. The interest rate on the savings accounts went up a little. Fall clean up days is scheduled for Sept. 29th and 30th.
The two old railroad cars will be removed soon. Council asked to have a letter sent to the owner of the old Hardee’s building. Council also wants to know the steps or process to clean up the old braille school power plant.
