REGULAR COUNCIL MEETING
MAY 10, 2018
A regular meeting of the City Council of Vinton, Iowa, was held on the 10th day of May, 2018,
at 7:00 p.m., in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and
the roll being called the following Council Members were present and absent: Present:
Edwards, Elwick, Hessenius, Hesson, Parr, Stark. Absent: None.
The Pledge of Allegiance was recited.
Motion by Elwick, second by Hesson to approve the agenda. Question: Ayes – All. The
Mayor declared the motion carried.
Motion by Elwick, second by Hessenius to approve the consent agenda. Question: Ayes – All.
The Mayor declared the motion carried. Items on the consent agenda are to receive and file the
council meeting minutes of April 26th, approve invoices in the amount of $654,696.56 and to
receive and file the April revenue and expenditure report.
Parr reported the public works committee had met to discuss street repairs. Another public
works committee will be held on May 24th at 6:00 pm with the street superintendent.
Edwards stated he had a resident request that City Hall and other municipal service stay located
in the downtown district.
The Mayor announced that now was the time and place set to hold a public hearing on a
nuisance abatement at 615 A Avenue. Owners Tim and Jane Osborn were not present. Lee
Bendull, 611 A Avenue, stated he had previously asked council to declare 615 A Avenue as a
junk yard. He says the backyard of 615 A Avenue has old steel gates, pallets, old tires and old
lawn mowers. The lean-to to their garage was built without a building permit. They were told to
remove it, but only a little part has been removed. Administrator Ward asked council to issue a
municipal infraction. He took pictures of the property this morning, showing it still has
numerous items in the yard. A notice of this public hearing was published in the local newspaper
and a copy of this notice of public hearing was personally hand delivered by Ward and Chief
Paxton. Ward stated that the maximum daily fine of $525.00 could be charged. The City could
seek an injunctive relief from the court to abate this nuisance. Jerry Michael, building inspector,
says this is a reoccurring situation. The Mayor closed the hearing.
Motion by Stark, second by Hessenius to declare the property as a nuisance property. The
Osborns will be notified on May 11, 2018 that the nuisance items need to be removed from the
front yard, back yard and right of way. If nothing is abated, the daily maximum fine of $525 will
start accruing on May 14, 2018, up to a maximum of $5,000.00. Question: Ayes – Edwards,
Elwick, Hessenius, Hesson, Parr, Stark. Nays – None. The Mayor declared the motion carried.
The Mayor announced that now was the time and place set to hold a public hearing on a
proposal to dispose of the structure from 211 North 8th Avenue. The parks and recreation
department no longer uses the house and wish to remove the house from this property. It was
suggested to sell it by auction on GovDeals.com. The auction will be on May 25th from 12:01 am
to 11:59 pm. A bill of sale will be given to the successful bidder. The City will waive the
typical publication and legal fees. The successful bidder will be allowed 120 days to remove the
house. The Mayor closed the hearing.
Motion by Stark, second by Parr to pass a RESOLUTION PROPOSING DISPOSAL OF AN
INTEREST IN PROPERTY BY SALE AND NOTICE OF PUBLIC HEARING. Question:
Ayes – Edwards, Elwick, Hessenius, Hesson, Parr, Stark. Nays – None. The Mayor declared the
motion carried and declared RESOLUTION 05-18-01 passed and approved.
The Mayor announced that now was the time and place set to hold a public hearing on a
proposed fuel dispenser improvement project for the airport. Last fall bids came in higher than
the engineer’s cost estimate, so no bid was awarded then. It was decided to re-bid the project
this spring. The Mayor closed the hearing.
Motion by Stark, second by Parr to approve an engineering services agreement with Veenstra
& Kimm, Inc. for wastewater treatment facility improvements 2020. Dave Schechinger and
Loren Leach, engineers, stated the design phase will take 12 to 15 months. A new lift station
with pumps and mechanical screens, a sludge storage building and replacing an existing
emergency generator will be designed. An SRF loan, revenue bonds and sewer rates are possible
sources for funding the project. Question: Ayes – Edwards, Elwick, Hessenius, Hesson, Parr,
Stark. Nays – None. The Mayor declared the motion carried.
Motion by Hessenius, second by Stark to pass a RESOLUTON PROPOSING DISPOSAL OF
AN INTEREST IN REAL PROPERTY BY SALE AND NOTICE OF PUBLIC HEARING.
Question: Ayes – Edwards, Hessenius, Hesson, Parr, Stark. Abstain – Elwick. Nays – None.
The Mayor declared the motion carried and declared RESOLUTION 05-18-02 passed and
approved. This is for E Avenue between 8th and 9th Streets.
Motion by Stark, second by Hesson to pass a RESOLUTION TO AMEND TRAFFIC
CONTROL DEVICES PERTAINING TO NO PARKING ZONES. Question: Ayes – Edwards,
Elwick, Hessenius, Hesson, Parr, Stark. Nays – None. The Mayor declared the motion carried
and declared RESOLUTION 05-18-03 passed and approved. No Parking will be allowed on the
south side of 8th Street from K Avenue to 8th Avenue.
Motion by Hesson, second by Stark to pass a RESOLUTION DIRECTING THE CLERK TO
PUBLISH NOTICE OF HEARING ON THE ADOPTION OF THE PROPOSED “CODE OF
ORDINANCES OF THE CITY OF VINTON, IOWA”. Question: Ayes – Edwards, Elwick,
Hessenius, Hesson, Parr, Stark. Nays – None. The Mayor declared the motion carried and
declared RESOLUTION 05-18-04 passed and approved.
Motion by Stark, second by Elwick to pass a RESOLUTION TO SUPPORT A FREE
ROAMING CAT PROGRAM IN VINTON TO IMPLEMENT THE TRAP, NEUTER, AND
RETURN METHOD AS AN EFFECTIVE WAY TO DEAL WITH STRAY AND FERAL
CATS. Question: Ayes – Edwards, Elwick, Hessenius, Hesson, Parr, Stark. Nays – None. The
Mayor declared the motion carried and declared RESOLUTION 05-18-05 passed and approved.
Parr reported that Chief Paxton is still looking at ordinances from other cities regarding ATVs
and UTVs or side-by-sides. Parr would like Vinton to allow UTVs in town like golf carts.
Motion by Hesson, second by Elwick to approve requests for Party in the Park activities on
June 21st to June 24th and the route request for Party in the Pink 5K on June 22nd. Question: Ayes
– All. The Mayor declared the motion carried.
Administrator Ward stated that FEMA has a proposed update to the flood map for Vinton.
Administrator Ward reported he had received a request from the Library for a street closing for
a craft beer event on August 11th. A special council meeting will be held on May 31st. Bid
opening for solid waste collection is at 2:00 on May 11th. IIW Engineering would like to talk to
council.
Clerk received notice that the recycling rebate from Republic Services was to be suspended for
a month due to market conditions. Received four building permit applications for fences. The
iVinton survey will be mailed out soon. Party in the Pink 5K memo will be on utility billing.
