REGULAR COUNCIL MEETING
JULY 27, 2017
A regular meeting of the City Council of Vinton, Iowa, was held on the 27th day of July, 2017,
at 7:00 p.m., in the City Hall Council Chambers, Vinton, Iowa. Mayor Pro Tem Stark presided
and the roll being called the following Council Members were present and absent: Present:
Elwick, Hessenius,Hesson, Maynard,Stark. Absent: Mayor Watson, Parr.
The Pledge of Allegiance was recited.
Vinton’s newest Police Officer, Alex Gutierrez, took an oath of office.
Motion by Elwick, second by Hesseniusto approve the agenda. Question: Aye – All. The
Mayor Pro Tem declared the motion carried.
Motion by Maynard, second by Hesson to approve the consent agenda. Question: Ayes – All.
The Mayor Pro Tem declared the motion carried. Items on the consent agenda are to receive and
file the council meeting minutes of July 13, 2017, to receive and file the Library Board meeting
minutes of June 14, 2017 and to approve the renewals of a class B liquor license with Sunday
sales for Cobblestone Inn & Suites, a class C liquor license with Sunday sales for Berry’s Lanes
Inc. and a class C liquor license with Sunday sales for Ron-Da-Voo.
Nate Kass, Fehr Graham engineer, reported there have been some issues with the E 3rd Street
reconstruction project. Old galvanized waterlines are leaking. Some service lines are not where
they thought they were. Some lines are a different size than what they thought. A credit of
$1,275 will be given to the City for a manhole.
Kass was asked about the 13th Street project. He stated the contractor is not interested in
doing any repairs. The contractor stated they had informed the City of potential issues. Motion
by Hessenius, second by Elwick to have Administrator Ward offer arbitration to the contractor
for repairs for the 13th Street project. Question: Ayes – All. The Mayor Pro Tem declared the
motion carried.
Kass also stated the contractor for the E 3rd Street project is not very interested in putting in
the water meter pits.
Motion by Hesson, second by Maynard to approve blocking off 4th Street from B Avenue to
2nd Avenue and 1st Avenue from 3rd Street to 5th Street on August 26th for BoomFest vendors
and activities. Question: Ayes – All. The Mayor Pro Tem declared the motion carried.
Motion by Hessenius, second by Maynard to approve a request from the Kiwanis Club for a 5K
race route on August 26, 2017. Question: Ayes – All. The Mayor Pro Tem declared the motion
carried.
Mike Riege, Cedar View Condominiums representative, spoke to Council about Cedar View
Drive. This street is privately owned. The street does not meet code requirements. He asked the
City to consider a variance and take ownership of this street. If it becomes a city owned street,
more footage will be needed for the public right of way. An issue is snow removal. The condos
pay $30 per month for this service. The condos do pay property taxes. Property taxes do not pay
for snow removal. The street department operates using road use taxes. A public works
committee will be set for later in August. Street Superintendent Erickson will be asked to attend.
Mayor Pro Tem Stark announced that now was the time and place set to hold a public hearing
on a proposal to designate an urban revitalization area for 507 First Avenue. There were no
comments. The public hearing was closed.
Motion by Hesson, second by Maynard to pass a RESOLUTION OF FINDING TO A
PROPOSED URBAN REVITALIZATION AREA (FORMAT L.C.) AND PLAN ADOPTION.
Question: Ayes – Elwick, Hessenius, Hesson, Maynard, Stark. Nays – None. The Mayor Pro
Tem declared the motion carried and declared RESOLUTION 07-17-03 passed and approved.
Motion by Maynard, second by Hesson to adopt an ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF VINTON, IOWA, BY DESIGNATING A NEW
REVITALIZATION AREA (FORMAT L.C.). Question: Ayes – Elwick, Hessenius, Hesson,
Maynard, Stark. Nays – None. The Mayor Pro Tem declared the motion carried and that said
ordinance had been given its initial passage.
Motion by Maynard, second by Elwick have on the next agenda to waive the third reading of the
above stated ordinance. Question: Ayes – Elwick, Hessenius, Hesson, Maynard, Stark. Nays –
None. The Mayor Pro Tem declared the motion carried.
Tionna Pooler, Independent Public Advisors, recommends increases in the water and sewer rates.
She also recommends reviewing the rates annually. She suggested larger increases for the next
couple of years and then just inflationary increases the following years. It was noted that the city
has less utility customers because of the tornado last summer, which took out some apartment
complexes.
Motion by Maynard, second by Elwick to adopt an ORDINANCE AMENDING THE CODE
OF ORDINANCES OF THE CITY OF VINTON, IOWA, BY AMENDING PROVISIONS
PERTAINING TO WATER RATES. Question: Ayes – Elwick, Hessenius, Hesson, Maynard,
Stark. Nays – None. The Mayor Pro Tem declared the motion carried and that said ordinance
had been given its second consideration.
Motion by Maynard, second by Hesson to adopt an ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF VINTON, IOWA BY AMENDING THE OFFICIAL
ZONING DISTRICT MAP OF THE CITY (GARWOOD). Question: Ayes – Elwick,
Hessenius, Hesson, Maynard, Stark. Nays – None. The Mayor Pro Tem declared the motion
carried and that said ordinance had been given its initial passage.
Motion by Elwick, second by Maynard to set a public safety committee meeting for August
24th at 6:00 pm to discuss a property maintenance ordinance.
Motion by Maynard, second by Hessenius to approve a pay estimate #5, final retainage, to WRH,
Inc. for $16,556.05, for UV lighting replacement at the waste water treatment plant. Question:
Ayes – Elwick, Hessenius, Hesson, Maynard, Stark. Nays – None. The Mayor Pro Tem
declared the motion carried.
Administrator Ward stated that City Code Chapters 124 and 126 dealing with housing
subdivision rules should be recorded at the county. He also stated that a 28E agreement with the
County would be needed to address reviewing the platting and zoning of housing subdivisions
within two miles of City limits.
Motion by Maynard, second by Hessenius to approve the purchase of a New Holland skid steer
loader for the street department from Kromminga Motors in the amount of $48,146. Question:
Ayes – Elwick, Hessenius, Hesson, Maynard, Stark. Nays – None. The Mayor Pro Tem
declared the motion carried.
Motion by Elwick, second by Hessenius to approve a permit for supervised display of fireworks
for Iowa Pyrotechnic Association at the Benton County Fairgrounds on August 25 and August
26. Question: Ayes – All. The Mayor Pro Tem declared the motion carried.
Motion by Maynard, second by Hesson to set a public hearing for August 10, 2017 on plans,
specifications, form of contract and estimated construction cost for fuel dispenser improvements
at the Vinton Veteran’s Memorial Airpark. Question: Ayes – Elwick, Hessenius, Hesson,
Maynard, Stark. Nays – None. The Mayor Pro Tem declared the motion carried.
Motion by Hesson, second by Elwick to approve a sidewalk reimbursement of $500 to Kathy
Chamberlain at 1210 B Avenue. Question: Ayes – Elwick, Hessenius, Hesson, Maynard, Stark.
Nays – None. The Mayor Pro Tem declared the motion carried.
Motion by Hesson, second by Elwick to approve the Mayor’s appointment of Bud Maynard the
council subcommittees of the General Government, the Culture and Recreation and the Business
Type Activities. Question: Ayes – All. The Mayor Pro Tem declared the motion carried.
Administrator Ward reported he had attended a Middle Cedar Watershed Management meeting.
Vinton is a focus point for this group. Scientists from universities will be studying Vinton.
Their next meeting is October 19th at the US Bank building. City Attorney Fischer was the
representative for the Mayor at a golf outing at Hunter’s Ridge, receiving 3rd place in the
tournament. Also, Attorney Fischer is on the Iowa Bar Association board. Administrator Ward
will be out of the office now until August 7th.
Clerk reported that paperwork for those seeking to be elected to a council seat is now available.
Good & Welfare: The Cedar River cleanup day is scheduled for August 5th. Vinton’s car
cruise was good.
Motion by Hessenius, second by Maynard to adjourn the meeting. Question: Ayes – All. The
