REGULAR COUNCIL MEETING
OCTOBER 13, 2022

A regular meeting of the City Council of Vinton, Iowa was held on the 13th day of October, 2022 at 7:00pm in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and the roll being called the following members were present: Bearbower, Elwick, Gates, Hessenius, Pflughaupt, Stark.

Motion by Pflughaupt, second by Gates to approve the agenda. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Bearbower, second by Gates to approve the consent agenda. Question: Ayes – all. The Mayor declared the motion carried. Items on the consent agenda are to receive & file Council meeting minutes of September 22 & 30, 2022, receive & file airport meeting minutes of September 21, 2022, receive & file library board meeting minutes of June 8, 2022, July 13, 2022 & September 14, 2022 and approval of City invoices.

Committee Reports
Stark reported the North Benton Ambulance board would like to meet with Council. A meeting is scheduled for Monday, October 17 at 5:30pm in City Hall.

Old Business
Motion by Gates, second by Pflughaupt to approve the first consideration of Ordinance 1076 – an ordinance amending the official zoning district map of the City (Sellers). The rezoning request for 903 B Avenue was sent back to the Planning & Zoning Commission for reconsideration. The Commission met to discuss and a motion was made for approval however it died on the floor due to lack of a second. The property owner disagrees with the definition of spot zoning used by the Commission. City staff will consult with the City Attorney. Gates and Pflughaupt withdrew their respective motions.

Motion by Pflughaupt, second by Gates to approve the third consideration and adoption of Ordinance 1077 – an ordinance amending provisions pertaining to alcoholic beverage control. Question: Ayes – Bearbower, Elwick, Gates, Hessenius, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Elwick, second by Gates to adopt Ordinance 1077 – an ordinance amending provisions pertaining to alcoholic beverage control. Question: Ayes – Bearbower, Elwick, Gates, Hessenius, Pflughaupt, Stark. The Mayor declared the motion carried.

Josh & Roni Frye, owners of J&R Sanitation were present to answer questions about their requested fuel surcharge on garbage collection. At this time, Frye is unaware of the gallons of fuel consumed for Vinton related routes. Frye will have staff track this for the next week or two. Council reminded Frye that the City is open to a fuel surcharge as long as the amount charged is justifiable and fair to both the residents and Frye’s. No action was taken.

Mayor Maynard opened the public hearing providing for the vacation and abandonment of previously dedicated easements and the vacation and transfer of previously dedicated street right of way, all as disclosed by the plat of Anderson Creek Estates First Addition to the City of Vinton, Iowa and proceedings related thereto and scheduling a public hearing related thereto. After no comments, Maynard closed the hearing.

New Business
Motion by Stark, second by Pflughaupt to approve the first consideration of Ordinance 1078 – an ordinance adding a new chapter 124 – food trucks. Question: Ayes – Bearbower, Elwick, Gates, Hessenius, Pflughaupt, Stark. The Mayor declared the motion carried.

Motion by Stark, second by Hessenius to approve a resolution approving the vacation and abandonment of previously dedicated easements and the vacation and transfer of previously dedicated street right of way, all as disclosed by the plat of Anderson Creek Estates First Addition to the City of Vinton, Iowa. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Pflughaupt, second by Stark to approve a resolution to declare certain City property as surplus property. Question: Ayes – all. The Mayor declared the motion carried. This is the car that was formerly used as the airport courtesy car.

Motion by Gates, second by Stark to approve sewer forgiveness at 603 E 4th Street in the amount of $83.48. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Gates, second by Pflughaupt to approve change order #1 from McDowells for the Shelter House Roof at Fisher Park in the amount of $2,030.89. The change order is for added materials and labor however the work is already complete.

Motion by Hessenius to amend the original motion to only pay the materials portion of the change order. Motion died due to lack of a second.

Motion by Elwick, second by Stark to amend the original motion to pay the materials and half of the labor costs on the change order. Question: Ayes – Bearbower, Elwick, Gates, Pflughaupt, Stark; Nays – Hessenius. The Mayor declared the motion carried. The amount being paid is $1,530.89.

The business type activities committee will meet on October 27 at 6:30pm to discuss the RFP for sanitation services beginning July 1, 2023.

Reports
City Administrator Ward reported he will be meeting with Hobart’s tomorrow. If Council is open to the idea, Ward would like to schedule a visioning session this fall with Council and department heads. Ward will seek a facilitator.

Parks & Recreation Director Boggess reported Fall Festival is kicking off. VPRD Night is tomorrow night at the Vinton Shellsburg football game.

Water/Sewer Superintendent Walker reported sludge hauling has begun. The new hire for the maintenance position will begin November 1.

City Clerk Schwan reported the storm siren from Duane Arnold is scheduled to be moved and reprogrammed by the end of the month. The information for vacancies for boards and commissions is posted for January 1. Work is being done to put the City code online is a more user friendly format.

Mayor Maynard reminded residents the open burning of landscape waste is permitted only on the last Thursday, Friday and Saturday in October (excluding October 31) and the first Thursday, Friday and Saturday in November. This will be permitted only during the hours of 7:00am to 9:00pm.

Good & Welfare
The Fire Department pancake breakfast is this Sunday serving from 7am to Noon.

With no other business before the Council, motion by Hessenius, second by Pflughaupt to adjourn. Approved unanimously. Time: 8:15pm
