REGULAR COUNCIL MEETING
SEPTEMBER 22, 2022

A regular meeting of the City Council of Vinton, Iowa was held on the 22nd day of September, 2022 at 7:00pm in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and the roll being called the following members were present: Bearbower, Elwick, Gates, Hessenius, Pflughaupt; Absent: Stark.

Motion by Gates, second by Pflughaupt to approve the agenda. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Bearbower, second by Elwick to approve the consent agenda. Question: Ayes – all. The Mayor declared the motion carried. Items on the consent agenda are to receive & file council meeting minutes of September 8, 2022, receive & file Parks & Recreation board meeting minutes of August 11 & September 8, 2022, receive & file library board meeting minutes of May 11 & August 10, 2022, approval of class C liquor license for Las Lomas Mexican Grill and approval of City invoices.

Committee Reports
The General Government committee met prior to the council meeting to discuss living fences. City staff will contact City Attorney for information.

Citizens Input
Darran Sellers, 1103 10th Avenue has a list of concerns about the development of the former Iowa Braille & Sight Saving School property.

Matt Boggess, 802 W 15th Street thanked Mr. Don Entas for all of the quiet work he’s done around the community.

Old Business
Motion by Gates, second by Bearbower to approve the second consideration of ordinance 1077 – an ordinance amending provisions pertaining to alcoholic beverage control. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Attorney Gage Kensler was present on behalf of J&R Sanitation to discuss the previously requested fuel surcharge. The latest request from J&R Sanitation is a flat $5.00 additional charge on each account to cover fuel costs. Council questioned how the $5.00 amount was determined. A list of questions will be given to J&R Sanitation for discussion at the next council meeting.

New Business
Mayor Maynard opened the public hearing for approval of resolution of necessity, estimate of cost, plat and schedule of assessments for a special assessment project. After no comments, Maynard closed the public hearing.

Motion by Hessenius, second by Pflughaupt to approve a resolution of necessity, estimate of cost, plat and schedule of assessments for a special assessment project (713 1st Avenue). Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Gates, second by Pflughaupt to approve a resolution providing for the vacation and abandonment of previously dedicated easements and the vacation and transfer of previously dedicated street right of way, all as disclosed by the plat of Anderson Creek Estates First Addition to the City of Vinton, Iowa and proceedings related thereto and scheduling a public hearing related thereto. Question: Ayes – all. The public hearing will be held October 13, 2022 at 7:00pm in the City Hall Council Chambers.

Motion by Elwick, second by Pflughaupt to approve approval of pay application #7 to Baker Enterprises in the amount of $25,718.40. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Gates, second by Pflughaupt to approve change order #8 to Baker Enterprises in the amount of $7,620.00. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Gates, second by Elwick to approve pay application #8 to Baker Enterprises in the amount of $14,851.35. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Pflughaupt, second by Gates to approve change order #9 to Baker Enterprises in the amount of $11,155.74. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion Gates, second by Pflughaupt to approve pay application #9 to Baker Enterprises in the amount of $0.00. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Gates, second by Pflughaupt to approve pay application #10 (retainage) to Baker Enterprises in the amount of $40,691.29. Question: Ayes – None; Nays – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. City staff may have located a manhole underneath the trail. City staff will investigate and contact Baker Enterprises.

Motion by Elwick, second by Bearbower to approve a security camera quote from Electronic Engineering for the Skate Center. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried.

Motion by Pflughaupt, second by Bearbower to approve the homebuyer assistance program check request for 713 E 5th Street. Question: Ayes – Bearbower, Elwick, Hessenius, Gates, Pflughaupt. Nays – None. The Mayor declared the motion carried. The City will be reimbursed from the CDBG grant.

Motion by Gates, second by Bearbower to approve the fireworks display request for Vinton Shellsburg Homecoming – September 23, 2022. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Bearbower, second by Gates to approve the sidewalk reimbursement for 1002 1st Avenue. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Pflughaupt, second by Hessenius to approve the sidewalk reimbursement for 1012 1st Avenue. Question: Ayes – all. The Mayor declared the motion carried.

Councilmember Pflughaupt read a proclamation for Mental Illness Awareness Week October 2-8, 2022.

Reports
City Administrator Ward reported he will be attending the League of Cities Annual Conference next week. A walk through on the 2nd phase of Anderson Creek is scheduled for tomorrow. The Vinton Early Learning Center is requesting a meeting early in October.

Water/Sewer Superintendent Walker reported the maintenance position at the sewer plant closes on Friday.

Parks & Recreation Director Boggess reported youth sports are in full swing. The scarecrow contest is coming up soon. The Kiwanis park shelter should be complete by the end of the month.
