REGULAR MEETING
SEPTEMBER 14, 2023

A regular meeting of the City Council of Vinton, Iowa was held on the 14th day of September, 2023 in the City Hall Council Chambers, Vinton, Iowa. Mayor Maynard presided and the roll being called the following members were present: Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark.

Motion by Stark, seconded by Gates to approve the agenda as presented. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Pflughaupt, seconded by Parmater to approve the consent agenda. Question: Ayes – all. The Mayor declared the motion carried. Items on the consent agenda include receive & file Council committee & regular meeting minutes of August 24, 2023, receive & file Parks and Recreation board meeting minutes of July 11 & August 10, 2023, approval of Class C retail alcohol license for Ron-da-Voo, approval of Class C retail alcohol license for Hops & Hotrods, approval of Class C retail alcohol license for Old Hospital Pub and approval of City invoices.

Communications, Petitions & Remonstrances
City Council received a resignation letter from Erin Monaghan from serving on the library board.

Committee Reports
The Rental Code committee met on the 13th. A meeting for October is scheduled. A work session was held prior to this council meeting with Rich & Nancy Farmer regarding subdividing of their lots.

Citizens Input
Chad Christoph, owner of rental properties in the community shared there are legal troubles facing Orange City, Iowa regarding their rental code and inspection process.

Old Business
Motion by Pflughaupt, seconded by Gates to approve the third consideration of ordinance 1088 – an ordinance amending provisions pertaining to flood plain management. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

Motion by Gates, seconded by Pflughaupt to adopt the above stated ordinance. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. The Ordinance takes effect upon publication.

Mayor Maynard asked for bids for the 512 W 6th Street property. Dakoda Sellers was the lone bidder with the offer of $1.00 for the parcel. With no other interest, Maynard ended the auction.

Maynard opened the public hearing on disposal of real estate owned by the City of Vinton (512 W 6th Street). Sellers shared that he plans to submit a request for alley vacation. With no other comments, Maynard closed the public hearing.

Motion by Gates, seconded by Parmater to approve a resolution directing the disposal of an interest in real property following a public hearing. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

New Business
Motion by Elwick, seconded by Pflughaupt to approve the first consideration of ordinance 1089 – an ordinance amending provisions pertaining to fiscal management. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. This ordinance update is a result of legislation passed in the last session.

Motion by Gates, seconded by Pflughaupt to approve the first consideration of ordinance 1090 – an ordinance amending provisions pertaining to liquor license and cigarette and tobacco permits. This ordinance update is a result of legislation passed in the last session.

Motion by Gates, seconded by Elwick to approve the first consideration of ordinance 1091 – an ordinance adding subsections regarding stop signs and no parking zones. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. The area designated in this ordinance is in the 2nd phase of Anderson Creek.

Motion by Stark, seconded by Parmater to approve the partial pay estimate #1 for the East Water Tower painting project for J.R. Stelzer. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

Motion by Parmater, seconded by Gates to approve a partial pay estimate #2 for the West 1st Street reconstruction project for Rathje Construction Company. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. At the time of this pay estimate request, work was on schedule however there have been delays since. Fehr Graham has asked for a written plan from the contractor to address the schedule changes.

Motion by Stark, seconded by Gates to approve a bid for West 4th Street Extension project from Central States Concrete for a cost of $28,414.00 plus the installation of geogrid. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

Motion by Gates, seconded by Elwick to approve the acceptance of the B Avenue Sanitary Sewer extension project. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. Work has been completed and acceptance is recommended by the City’s engineer on the project, Fehr-Graham.

Motion by Gates, seconded by Parmater to approve pay estimate #2 (final retainage) for B Avenue Sanitary Sewer extension project. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

Motion by Gates, seconded by Pflughaupt to approve the purchase of (2) Chevy Tahoes from Karl Chevrolet for the police department. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried.

Motion by Pflughaupt, seconded by Gates to approve a quote for City Hall exterior painting project. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. The work will be completed by CetraPro Painters.

Motion by Gates, seconded by Stark to approve a disbursement request from the Vinton Community Foundation. Question: Ayes – Elwick, Gates, Hessenius, Parmater, Pflughaupt, Stark. Motion carried. This is the annual disbursement that is included in the budget planning.

Motion by Elwick, seconded by Parmater to approve a sidewalk reimbursement for 407 West 6th Street. Question: Ayes – all. The Mayor declared the motion carried.
Motion by Stark, seconded by Pflughaupt to appoint Tanner Davis to the Vinton Parks & Recreation Board for a term ending June 2026. Question: Ayes – all. The Mayor declared the motion carried.

Motion by Pflughaupt, seconded by Parmater to approve a special events application for the Tim Petersen Memorial Ride. Question: Ayes – all. The Mayor declared the motion carried.

Trick or treating will be held Tuesday, October 31 from 5-8pm.

Reports
City Administrator Ward reported the Electric Department wants to talk about the possibility of lining the sanitary sewer line in front of the Generation Plant. Ward will be attending the League of Cities conference next week.

Parks & Recreation Director Boggess reported fall sports programming has started.

Police Chief Paxton reported a full-time officer has moved to part-time status. One of our reserve officers is currently in the academy and will likely fill that full-time position.

With no other business before the Council, motion by Hessenius, second by Gates to adjourn. Approved unanimously. Time: 8:00pm.
